Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you and nCheck governing your access to and use of our virtual private network (VPN), custom domain name resolution (DNS), and related routing services. By establishing an account or using our infrastructure, you unconditionally agree to be bound by these Terms.

1. Services Overview

nCheck provides highly secure virtual private networking services utilizing modern tunneling protocols, alongside optimized privacy-focused DNS resolution and filtering frameworks. Our tools are built to protect active data transmissions and grant users superior network control.

2. Eligibility and Authority

To register an account or interact with our paid services, you must be at least 18 years of age or possess valid legal parental/guardian consent, and hold the absolute legal capacity to enter into binding contractual agreements under the laws of your jurisdiction.

3. Account Registration & Security

To provision service access, you are required to submit an active email address. You assume complete responsibility for safeguarding your account credentials, access tokens, or configuration keys. Any network actions occurring under your registered profile remain your sole responsibility.

4. Core Alignment with No-Logs Architecture

We enforce a strict operational No-Logs rule across our entire routing network. As detailed in our official No-Logs Policy, our systems do not log or store historical data regarding your assigned IP mappings, browsing activity, transmission contents, network session durations, or absolute bandwidth quantities. Our infrastructure operates dynamically in volatile memory (RAM), ensuring zero persistence of tracking parameters.

5. Service Infrastructure Providers

To secure optimal routing paths and localized low-latency access, our systems utilize trusted South African infrastructure and datacenter providers, specifically: Webway, HostAfrica, and Axxess. Our network core endpoints are physically hosted in enterprise facilities within Cape Town and Johannesburg.

6. Acceptable Use Policy (AUP)

You explicitly agree to utilize our services solely for lawful purposes. You are strictly prohibited from utilizing nCheck networks to perform or facilitate:

nCheck maintains the explicit right to block protocol vulnerabilities or terminate access keys dynamically in real-time to defend our systems against ongoing network abuse.

7. Intellectual Property & Copyright Notice

nCheck respects intellectual property rights and expects its users to do the same. Because our VPN and DNS systems run on a strict, real-time stateless protocol without saving data logs, we do not possess the historical data required to trace external copyright or DMCA infringement notices back to individual accounts. However, intentional and systematic exploitation of our platforms to violate copyright standards constitutes a breach of these Terms and may result in immediate service termination.

8. Service Availability & Performance Disclaimer

While we make reasonable commercial efforts to ensure maximum system operations, our services are provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted system access or specific network speeds. Traffic throughput can vary based on upstream routing updates, hardware maintenance, or general internet volatility.

9. Sub-Processors & Operational Partners

We partner with select third-party enterprise tools to execute administrative functions, including secure billing networks and core transactional messaging frameworks (such as Google / Workspace and Domains.co.za). We are not legally accountable for independent changes to third-party provider platforms.

10. Payments, Subscriptions, & Cancelations

All service access keys are provisioned based on explicit prepayment cycles. Due to the nature of software allocation and instant infrastructure deployment, payments are generally non-refundable unless explicitly mandated by prevailing consumer protection standards. Failure to settle recurring invoice cycles will lead to automatic system credential suspension.

11. Limitation of Liability

To the maximum extent permitted under applicable South African laws, nCheck, its directors, employees, or infrastructure partners shall not be liable for any indirect, incidental, punitive, or consequential damages arising out of your utilization of our network keys. Our aggregated liability for any formal claims brought under this agreement is strictly capped at the total financial amount paid by you to nCheck during the three (3) months immediately preceding the event giving rise to liability.

12. POPIA Compliance & Information Desk

We process all operational client profiles in strict adherence to the Protection of Personal Information Act (POPIA) of South Africa. We preserve and uphold your statutory right to access, inspect, modify, or completely wipe your registration details upon direct request.

13. Choice of Law & Exclusive Jurisdiction

These Terms, along with your entire commercial relationship with nCheck, are governed exclusively by the laws of the Republic of South Africa. You explicitly consent that any legal actions, disputes, or formal proceedings arising directly out of these terms must be brought solely before competent courts operating in South Africa.

14. Contractual Modifications

We reserve the right to modify these Terms at any time. Your continued use of nCheck platforms following the deployment of adjusted conditions constitutes an explicit acceptance of the revised legal terms.
